Swaminatha150Tara Swaminatha is an Of Counsel in DLA Piper’s Cybersecurity practice based in DC with 17+ years’ experience in the information security and privacy industry. Tara is one of a handful of attorneys in the country with a rare combination of federal computer crime prosecution experience, experience representing clients on cybersecurity matters, and technical security knowledge.  In 2015, Tara was outside cybersecurity counsel to clients in two of the most significant data breaches of the year.

Prior to her current position with DLA Piper, Tara was a federal prosecutor with the Department of Justice’s Computer Crime and Intellectual Property Section.  There she litigated federal criminal IP crimes in federal courts throughout the country, including large-scale, multi-jurisdictional domestic and international crimes involving counterfeit business software, electronic games, motion pictures, and luxury goods.  She also supervised forensic investigations.

Tara is member of the Office of the General Counsel’s Compliance Committee.

During security or privacy incidents, Tara quarterbacks the incident response effort and, during ensuing litigation or regulatory investigations, serves as her client’s subject matter expert. Drawing from her experience litigating cases for the federal government, Tara has extensive understanding of how digital evidence may be used to prove facts litigation in security incidents.  Tara works to minimize clients’ litigation exposure by applying this knowledge during incident responses, investigations and data breaches involving exposure of millions of records of customer information. She works directly with forensic investigators to review evidence. She directs or re-direct investigations so focus efforts on the issues most critical to understanding a client’s legal exposure.

Tara conducts comprehensive liability risk assessments for clients to determine (and minimize) cybersecurity-related liability exposure. This component of Tara’s practice is informed directly by her active work representing clients in security incidents and ensuing investigations and litigation as described above.

Tara helps structure clients’ incident response plans (in concert with technical experts as appropriate) ensuring they are adequate, achievable and useful during a crisis.

Tara draws from her technical experience to help “big data” clients maximize the use of consumer information while minimizing related risks by enlisting experts to identify strong encryption and technical security measures to protect and de-identify consumer data.
